Terms of Service

1. What lalalust is

lalalust is a marketplace for commissioned adult content. Customers describe what they want and name a budget; verified creators send offers; the customer picks one and pays lalalust, which holds the money until the delivery is approved.

lalalust is not the producer of the content and is not a party to what is made. The contract for the work itself is between the customer and the creator. lalalust operates the marketplace, verifies creators, checks deliveries against the brief, holds the money, and decides cases. Those services are what our fee pays for.

2. Who may use it

• You are at least 18 years old, or the age of majority where you live if that is higher. There is no exception to this. At the entrance we ask you to confirm it; that confirmation is a declaration by you, not a check we perform, and a false one is a breach of these terms.
• You are legally allowed to view adult material where you are. Access from places where this material is illegal is prohibited, and using a proxy to disguise that is a breach of these terms.
• You use one account, in your own name or a pseudonym you control. Accounts may not be shared, sold, rented or transferred.
• You have not previously been removed from lalalust for a safety breach.

3. How a commission works

The brief is the contract

What the customer writes down — the description, the must-haves, the deadline, the price — is the brief, and it becomes binding on both sides the moment an offer is accepted. Every later decision, including a case decision, is measured against it. Neither side can change it afterwards without the other agreeing in writing inside the order.

The money is held

Payment is made to lalalust, not to the creator. The amount is reserved and credited to nobody. The creator can see that the order is funded — that is why she starts work — but cannot access it.

Delivery, revisions, approval

• Where useful, the creator sends a preview first: images watermarked, video as a short clip.
• 2 revisions are included. A revision request must state what deviates from the brief, not what you would now prefer.
• A person at lalalust checks the final delivery against the brief before it reaches the customer. A delivery that plainly misses the brief is returned to the creator.
• The customer then has 72 hours to approve or open a case. Silence completes the order automatically and pays the creator — that protects her from an order that hangs forever.

Fees

lalalust charges up to 15 % of the order value, deducted from the creator's side. Creators who are ranked in the top three of the current week pay a reduced 10 % on orders settled while they hold that rank; everyone else pays 15 %. The customer pays the price shown and nothing on top. There is no listing fee and no charge for a profile. Velvet is an optional paid pass for customers with its own price — nothing on the marketplace requires it.

4. What you get, and what stays with the creator

Unless the brief says otherwise in writing, a customer receives a delivered file for personal, private use only. The creator keeps copyright and all rights in her own likeness. Reselling, republishing, uploading elsewhere, feeding it to a model for training, or using it commercially requires her written agreement, given in the brief.

Sharing a delivery outside lalalust without that agreement is both a breach of these terms and a copyright infringement, and we act on it as such.

5. What is not allowed

The full list is in the Acceptable use policy, which forms part of these terms. In short, and without exception:

• Anyone under 18, in any form — real, drawn, generated, described, or an adult presented as a minor. This is reported to the authorities, not merely removed.
• Anyone who has not consented, including hidden recordings and material shared without permission.
• Coercion or trafficking, or any sign that a person is not there freely.
• Real violence or injury, animals, incest framing, impersonation of a real person.
• Anything illegal where either party is.
• Meeting in person, escorting, or turning a commission into a physical service.
• Taking payment or delivery off the platform to avoid our protections, our checks or our fee.
• Posting contact details in public text, or asking a creator to remove a watermark from a preview.

6. Payments, refunds and cases

Card payments are not open yet. At present money moves only inside your lalalust balance: the balance is topped up through the checkout page, and orders, refunds and payouts are settled against that balance. No card is charged per order, and card data never reaches our servers because we do not accept cards.

7. Moderation, suspension and appeal

We review profiles, portfolio items, catalogue entries and wishes before they become visible, and we can remove content or suspend an account where these terms or the acceptable use policy are broken.

You are always told what was removed and why, with a reference. You may appeal once, in writing, and a different person reviews it. We answer appeals within seven days. A content decision does not by itself move money: funds already held are settled through the normal refund or case route.

The one exception to notice-before-action is content reported as involving minors or non-consent. That is removed on sight, pending review, and the account is suspended immediately.

8. Liability

lalalust is liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and where liability is mandatory under the law that applies to us. For slight negligence we are liable only for breach of an obligation whose fulfilment makes proper performance of this contract possible in the first place and on which you may reasonably rely, and then only for damage that was foreseeable and typical for this kind of contract.

We do not warrant that a wish will attract offers, that a particular creator will accept an order, or that the service is available without interruption. We are not liable for the artistic merit of a delivery that matches the brief.

9. Duration and ending it

You may close your account at any time in Settings. Active orders must be completed and your balance must be at zero first — otherwise someone else's money would be stuck. Creators request a payout from the wallet; customers with a balance left over have no self-service payout button and should write to support@lalalust.com, who settle it by hand. We may terminate with notice for a breach of these terms, or immediately for a safety breach.

After deletion your profile is anonymised permanently. A small set of records survives because the law requires it: invoices for tax purposes and the age and consent declarations attached to published files. See Privacy Policy.

10. Changes to these terms

We may change these terms. Material changes are announced at least 30 days in advance by email and in your account. If you do not object before the new version takes effect, it applies to you; if you object, you may close your account and any held funds are settled normally. Changes that only correct a mistake or reflect a change in law can take effect immediately.

11. Law and jurisdiction

The law at the operator's registered seat applies — the seat is the address named in the Imprint — excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, this does not deprive you of the protection of mandatory provisions of the law of your own country. The European Commission's online dispute resolution platform is at ec.europa.eu/consumers/odr; we are neither obliged nor willing to take part in proceedings before a consumer arbitration board.

If a provision of these terms is or becomes invalid, the rest remains in force.
